Three Killed in Recent Tractor-Trailer on I-75 Accident Near Marietta

Three people were killed recently when the car they were in was hit by a tractor-trailer on Interstate 75, just north of North Marietta Parkway.

Marietta Police say that a 2009 Nissan Rogue was stopped in the center lane of I-75 northbound just before 6AM when it was struck by a tractor-trailer.

The truck driver wasn’t hurt, and it’s not clear why the Nissan was stopped before the crash. The Marietta Police Selective Traffic Enforcement Program (STEP) Unit will investigate the wreck.

Note that just because the Nissan was stopped in the road doesn’t mean that the driver of the car was totally at fault. Why is a Commercial Trucking Accident Lawsuit Different than a Regular Car Accident?

In addition to the number of parties that may be responsible, truck drivers must comply with the Federal Motor Carrier Safety Regulations (FMCSRs) which set out the minimum standards for drivers of commercial tractor-trailers. For example, a truck driver can only work a maximum of 14 consecutive hours after 10 consecutive hours off-duty. Drivers’ driving time is limited to a maximum of 11 hours during the 14-hour on-duty period.

There’s also a 60/70-Hour Duty Limit in which drivers can’t exceed 60 hours on duty over a week, or 70 hours on duty over eight days.

Violations of the FMCSRs can be used as evidence in litigation when a person is injured by the negligence of the truck driver or his or her company.
